On October 6, 2015, the European Union Court of Justice (ECU) ruled that the EU Commission’s Safe Harbor program, which permitted the transfer of customer data between the EU and the United States, was invalid.

The European Commission has been working on Safe Harbor 2.0 and has suggested some alternatives that U.S. companies can use in the absence of Safe Harbor, namely, standard contractual clauses and binding corporate rules. Fortunately, Olympus’ privacy policies confirm our commitments to provide the necessary protections, and we also happily include contractual protections in our agreements. If you have any concerns, we have a standard contractual clauses document designed to satisfy the EU’s Data Protection Directive, which we can execute with any client that has concerns about this matter. In the meantime, we will continue to ensure that we have proper safeguards in place to protect the data that is under our care, and we will monitor any developments concerning this issue.
